Five Oaks Contracting Workmanship & Structural Warranty

1-Year Workmanship Warranty Five Oaks Contracting offers a 1-year (365 days) warranty on labor for defects in workmanship. This warranty excludes:
  • Materials, material failure, and manufacturer’s recommended use
  • Client negligence or misuse
  • Normal wear and tear
  • Acts of God (e.g., natural disasters)
  • Changes of mind
The warranty is valid only upon full payment; incomplete payment voids the warranty. Warranty work does not extend the original warranty period. At its discretion, Five Oaks Contracting may offer a partial refund instead of warranty work. If the Client or their contractor modifies the work, the warranty is void.
The warranty and estimate are non-transferable and must be accompanied by the original contract for any claims.

10-Year Structural Warranty: In addition to our 1-year workmanship warranty, Five Oaks Contracting provides a 10-year structural warranty covering work on load-bearing members in buildings and outdoor structures like decks. This warranty ensures the structural integrity of our work against defects in materials and labor related to these critical components.

  • Please note: This warranty excludes damage due to natural disasters, improper maintenance, or alterations made by parties other than Five Oaks Contracting.

Warranty Exclusions

Excluded from this warranty are items such as:
  • Caulking, grouting, drywall cracks
  • Blocked plumbing and leaks unless a unit (e.g., faucet) was replaced
  • Matching of existing materials (e.g., paint, tile)

Materials & Client-Supplied Products

  • If materials are supplied by Five Oaks Contracting, the manufacturer’s warranty applies.
  • Clients may supply materials, subject to Five Oaks Contracting’s approval.
  • Clients agree to reimburse Five Oaks Contracting for any materials purchased on their behalf, plus a 15% markup, unless included in the estimate.
  • Five Oaks Contracting provides no warranty on materials and will not reimburse materials under any circumstances.
The Client is responsible for selecting materials and ensuring they meet aesthetic preferences. Matching existing materials is not guaranteed.

Permits, Utility Flagging, & Debris Removal Unless explicitly stated otherwise, the Client is responsible for:

  • Any changes to the scope of work require written approval and a revised price.
  • If hidden issues (e.g., structural damage, plumbing/electrical deficiencies) are discovered, work will pause and a new estimate will be provided.
  • Work will not continue until the Client agrees to the changes.

Disputes & Payment Terms

  • Disputes will be resolved through binding arbitration, and the prevailing party covers collection and legal fees.
  • This warranty supersedes all previous agreements, and Five Oaks Contracting is not liable for consequential damages.
  • Any representations outside of this warranty are disclaimed.
  • Payment is due upon completion. The Client’s signature on the estimate and contract confirms acceptance of the work’s quality and completion.
  • A $50 fee will be charged for returned checks.
